Auction Terms & Conditions Terms: 1. Successful bidder will sign a standard Offer to Purchase form directly following the auction. Offer will be a cash offer with no contingencies of any kind. 2. Earnest money shall be $25,000 per parcel and will be collected immediatley following the auction. If the high bid is accepted, the earnest money will be applied toward the purchase price. If the bid is not accepted, the earnest money will be returned to the buyer. 3. The offer is subject to approval of the owner, who will have until August 11, 2022. The seller may accept, reject, or counter today's high bid. 4. This offer may not be rescinded prior to Midnight of August 11, 2022. 5. In the event of a counter-offer, today's high bidder will be given the first opportunity to accept any counter offer. 6. The buyer is purchasing the property in its "AS IS" condition with all its faults. No warranties are made as to the electrical systems, mechanical systems, structural soundness, well, septic system (if any) or any other aspects regarding the property. Buyers shall rely entirely on their own inspections of the property and the records. 7. A Real Estate Condition Report has been provided, however the buyer is purchasing the property in its AS IS condtion. 8. If the offer is accepted, closing will take place on or before September 28, 2022. 9. Real estate taxes will be prorated at the time of closing based on the 2021 taxes. 10. Growing Crops are not included in the sale. Crops will remain the property of the sellers for the 2022 growing season. The seller will have the right to access the land after closing for purposes of harvesting crops until crops are harvested or December 31, 2022. 11. Tillable acreages were derived from FSA Maps but are not guaranteed. 12. Wooded grounds on Parcels 4, 5, 6 & 7 are enrolled in the MFL program. Buyer accepts the property that way. 13. No personal property is included in the sale including cattle, feed, machinery, cement coffin blocks near free stall building and in commodity shed, fuel barrels, free standing gates, black dirt pile near feed pad & any other personal property. 17. All milking equipment, hanging gates and any remaining appliances will stay with the farm. Any personal property being left at the farm at closing is being done so solely at the convenience of the seller and is considered to have no monetary value. 18. The feed will be removed on or before October 31, 2022, Buyer accepts this and agrees to allow the purchaser to have access to remove the feed. 19.
